STF Extends Suspension of Fines Regarding Mental Health in NR-1

The Supreme Federal Court (STF), Brazil’s highest court, through a decision by Justice André Mendonça, determined a 90-day extension to the suspension of fines applied for non-compliance with mental health rules provided in Regulatory Standard 1 (NR-1).

The role of the AGU and next steps

With the extension of the suspension of penalties, the legal debate regarding the requirement of these mental health rules in the workplace gains additional time for analysis. As part of the procedural developments, the Office of the Attorney General of the Union (AGU) — the body that represents the federal government in legal matters — was called upon.

The AGU must present detailed information regarding the proposal to forward the discussion to the Secretariat for Jurisdictional Support (Sejan) within the STF. The purpose of this step is to seek a resolution or institutional alignment prior to the resumption of punitive inspections.

Practical impact on companies

For human resources departments and corporate executives, the decision offers temporary relief. During this 90-day period, organizations cannot be fined specifically for failing to comply with the mental health rules introduced in NR-1.

Nevertheless, the topic remains on the STF agenda and may see further developments once the AGU and Sejan conclude the proposed discussions.
