The National Council of Justice (CNJ, the administrative watchdog of Brazil’s judiciary) issued a decision that simplifies legal representation in court proceedings in Brazil. The body authorized the use of powers of attorney signed via the gov.br platform in lawsuits across the entire Judiciary.
Validity of signatures via gov.br
A power of attorney is the document by which an individual or company grants authority to a lawyer to act on their behalf. With the increasing digitalization of public services, the gov.br platform has become a central tool for electronic identification in the country.
According to the CNJ’s ruling, the lack of a traditional digital certificate does not justify the generic and automatic rejection of these documents by courts. This means judicial instances must recognize the validity of signatures executed through the government platform.
Efficiency in litigation
The decision brings direct practical impacts to the business environment. For founders, executives, and foreign investors with representation in Brazil, the measure reduces bureaucracy when formalizing legal representation.
By barring automatic rejection due to the lack of a digital certificate, the CNJ standardizes the approach across the Brazilian court system. This standardization avoids procedural delays and brings greater efficiency to corporate routines that rely on judicial proceedings.
